These Terms of Service ("Terms") govern all digital bookings, freight forwarding requests, customs brokerage actions, warehousing, and transportation services managed by Cargosphere Global Logistics. By utilizing our platform, submitting quote parameters, or initiating cargo bookings, you enter a legally binding contract with us under the following terms.
1. Cargo Descriptions and Shipper Responsibility
The client ("Shipper") guarantees that all items delivered to Cargosphere Global for transport are packaged securely for long-haul shipping, accurately described, and compliant with international shipping guidelines. Shippers are strictly required to declare any hazardous materials (HAZMAT) or regulated substances (including lithium batteries, chemicals, or magnetic materials) in absolute compliance with IATA and IMDG cargo standards. Shippers assume full liability for any physical damage, delay fines, or legal penalties resulting from undeclared, mislabeled, or illegal cargo shipments.
2. Rates, Surcharges, and Re-Weighing
Initial shipping rates are generated as estimates based on the physical weight, volume, and commodity description provided by the Shipper in the Booking Wizard. Cargosphere Global reserves the right to re-weigh, re-measure, and re-classify cargo upon physical arrival at our regional warehouses or port terminals. If physical properties exceed declared specs, Cargosphere Global will apply rate adjustments, terminal re-handling fees, and storage surcharges prior to final container loading.
3. Transit Estimates and Force Majeure
All estimated transit times (ETAs) and shipping schedules are estimates and do not represent guaranteed delivery dates. Cargosphere Global is not liable for cargo delays, demurrage, or associated business losses arising from events beyond our reasonable control (Force Majeure), including customs audits, border detentions, severe weather conditions, port congestions, shipping carrier equipment shortages, or labor strikes.
4. Insurance and Carrier Liability Limit
Under international maritime (Hague-Visby Rules) and aviation (Montreal/Warsaw Conventions) laws, carrier liability for cargo loss or physical damage is capped at minimal statutory weight thresholds (SDR per kilogram). Therefore, Cargosphere Global strongly recommends and offers comprehensive door-to-door All-Risk Marine & Transit Cargo Insurance. In the event of an uninsured claim, Cargosphere Global's maximum liability is strictly limited to these international carrier caps.
